This Privacy Policy explains the practices of MigrationKing LLC, Inc. ("MigrationKing LLC") with respect to how personal information is collected, used and disclosed by MigrationKing LLC in connection with this website at www.migrationking.com or any successor website (the “Site”) or related services ("Service") which may require a download, installation and use of certain MigrationKing LLC client software ("*"). This Privacy Policy does not apply to any data you have stored through the Service.
This Privacy Policy applies to personal information collected online through your interaction with or use of the Site and Service. This Privacy Policy does not apply to information collected by third parties or their websites, products or services.
1. Changes in Privacy Policy
MigrationKing LLC may change this Privacy Policy at any time. MigrationKing LLC will provide notice of changes to the Privacy Policy by indicating on this Privacy Policy the date it was last updated and making such updated Privacy Policy available on the Site. We encourage you to review this Privacy Policy whenever you visit our Site or use the Service to make sure that you understand how any personal information you provide will be used.
2. Personal Information Collection
We may collect various types of information about you including personal, demographic and aggregate data. As used herein, "personal information" means information that specifically identifies you such as your name, address, telephone number and email address. Demographic information is anonymous information, which may include your age, date of birth, gender, demographic area, hobbies or interests. Demographic information is not considered personal information unless it is linked with your other personal information, which we may do for a variety of reasons such as customizing content according to your interests and preferences. Personal information does not include aggregate information, which is data we collect about the use of the Site or Service (or categories of the Site or Service), from which personal information has been removed. In addition, MigrationKing LLC may ask you to provide certain personal information when filling out and submitting registration, feedback, bug report, or new feature request forms to MigrationKing LLC on the Site. When you use the Site and the Service, MigrationKing LLC may also collect certain information about your computer to facilitate and evaluate your use of the Site and the Service. MigrationKing LLC also uses such information to measure traffic patterns on the Site and usage of the Services.
The Service may require you to use the most current version of the MigrationKing LLC Software. Software published by MigrationKing LLC may automatically check to determine if you are using the most current version of the MigrationKing LLC Software. During this process, an IP address identifying your computer, operating system version and the MigrationKing LLC Software version may be collected via the Internet, but system profile information is not transmitted nor are cookies used to store information for this process. Additional personal information may be automatically collected through the use of the Site or Service, as described further below (See "Tracking, use of cookies, web beacons and similar devices").
We may on occasion supplement the personal information you submit to us with information from third-party sources. For example, if permitted under applicable law, we may supplement your Registration Information (defined below) with address information provided by the U.S. Postal Service to qualify your information and prevent errors in our database. As permissible, we may also supplement the information you provide to us with demographic and other information (such as age or interests) stored in third-party databases in order to make it more likely that marketing communications we send will be of interest to you.
3. Personal Information Usage

To automatically determine if you are using the most current version of the MigrationKing LLC Software and to send you email messages, present pop-up boxes on your computer, or utilize similar notification mechanisms to inform you if need to upgrade in order to use the Service you have requested.
4. Personal Information Sharing
MigrationKing LLC does not sell or rent personal information to third parties. We may share your personal information with vendors and service providers who perform functions on our behalf, but we limit their use of the information as is reasonably necessary to carry out their work. There are other instances in which MigrationKing LLC may disclose your personal information, such as where required by law, regulation or litigation. In extraordinary circumstances, we may also disclose personal information about you if we determine that such disclosure should be made for reasons of national security, an urgent matter of public or individual safety or other issues of dire importance. In addition, personal information may be disclosed or transferred to our affiliates and as part of, or during negotiations of, a merger, consolidation, sale of company assets or equity, financing, acquisition, strategic alliance or in any other situation where personal information may be transferred as one of the business assets of MigrationKing LLC. If you establish an account with MigrationKing LLC after clicking an affiliation link on a third party web site, or if your account registration identifies a MigrationKing LLC Partner who referred you to MigrationKing LLC, your domain name and the time of your referral will be displayed to that MigrationKing LLC Partner for tracking purposes, but MigrationKing LLC will not share the remainder of your email address or any other personal information (e.g., if John@example.com) is referred by a MigrationKing LLC Partner at 12 noon on Jan. 1, 2012, that MigrationKing LLC Partner could access an administrative page indicating that MigrationKing LLC received a referral of someone from example.com at that time.
5. Personal Information Choice
MigrationKing LLC recognizes and appreciates the importance of responsible use of personal information collected on the Site and in connection with the Service. MigrationKing LLC may communicate information to you regarding products, services and special offers available from MigrationKing LLC or selected third parties unless you have opted not to receive such communications or such communications are prohibited by law. If you do not wish to receive such email, regular mail or other messages, you may opt out at the time of registration or information collection. If you wish to change your contact preferences at a later date, you may login to your account settings at the Site and update your contact preferences. Please note that even if you opt out of receiving email or other communications from MigrationKing LLC, we may find it necessary to continue to communicate with you regarding your use of the Site and the Service, such as messages related to transactions or services you have specifically requested, in response to any email from you to us, to notify you of updates or changes to our policies and procedures, or to otherwise provide you with information we believe is important to users. Our systems may require time to update, so your opt-out requests may not be updated immediately.
6. Personal Information
The personal information that you provide in connection with registering yourself as a user of the Site or of the Service is classified as Registration Information. Registration Information is protected in several ways. Access by you to your Registration Information is available through a password and unique customer ID selected by you. This password is encrypted. To protect the confidentiality of your Registration Information, you should not divulge your password to anyone. You are responsible for all uses of the Site and Service by any person using your customer ID and password. Please advise us immediately if you believe your password has been compromised. In addition, your Registration Information resides on servers that only selected MigrationKing LLC personnel and contractors have access to. MigrationKing LLC encrypts your Registration Information that you submit to MigrationKing LLC through the Site, and thereby strives to help prevent unauthorized parties from viewing such information when it is transmitted to MigrationKing LLC.
Personal information that you provide or that we otherwise collect that does not constitute Registration Information also resides on servers and is accessible only to selected MigrationKing LLC personnel and contractors.
Please note that any information you post to a public bulletin board, blog or chat room, such as the MigrationKing LLC Community Forums (the "Forums"), is available to all persons accessing that location, and your email address may also be posted on these venues. The information you share, including your email address, would then be available to all persons accessing these venues, and such information may be read, collected or used by others for any purpose, including sending you unsolicited messages. MigrationKing LLC is not responsible for any information you elect to submit in these venues or the use of such information. In addition, you should be aware that the Forums offer a service in which subscribers are emailed a copy of all messages posted to the Forums on a particular topic. Consequently, if you post a message to the Forums, your email address will be sent to those subscribers who have indicated an interest in the topic of your message.
7. Data Collection
Personal information that is not collected on the Site or in connection with the Service is not generally subject to this Privacy Policy. This Privacy Policy also covers licensee information (such as contact name and address) provided in connection with MigrationKing LLC’s volume licensing program.
The Site may contain links to other websites at which personal information is collected. In such instances, unless expressly provided to the contrary, the collection, use and disclosure of your personal information will be governed by the privacy policy applicable to that website, and not by this Privacy Policy. MigrationKing LLC has established relationships with various service providers whose services are available to you from the Site, from websites that are linked to the Site, or in connection with the Service. Typically, these providers offer services that MigrationKing LLC customers might find useful, such as those that can be used in conjunction with Service. In order to use those providers’ services, you may be required to provide personal information to the providers. Unless expressly provided to the contrary, personal information that you provide while you are visiting a provider's website will be subject to the privacy policy posted on that site, and personal information that you provide while on the Site will be subject to this Privacy Policy.
8. Cookie Tracking
In order to improve our Service to provide more convenient, relevant experiences to our customers, we and our vendors may use "cookies", “web beacons”, and similar devices to track your activities. A cookie is small amount of data that is transferred to your browser by a web server and can only be read by the server that gave it to you. It functions as your identification card and enables MigrationKing LLC to record your passwords, purchases and preferences. Some products and services allow the tracking of access to or use of Services by users, as opposed to MigrationKing LLC.
